1. Acceptance of Terms

By accessing or using Klar at klar.marcelmoyo.workers.dev (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you ("User", "you") and Klar Money ("Klar", "we", "us"). Your use of Klar is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

If you are using Klar on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Who We Are

Klar Money operates the Klar personal finance application. For support and legal queries, contact us at hello@klarfinance.co.za.

Klar is not a bank, financial institution, investment adviser, or credit provider. We are a software application that helps you organise and visualise your own financial data.

3. The Service

Klar provides a personal finance management web application with features including (but not limited to):

Features may vary by subscription plan and region. We reserve the right to modify, add, or remove features at any time. We will provide reasonable notice of material changes.

4. Account Registration

Klar can be used without registration (local-only mode). To enable cloud sync and certain premium features, you must create an account using a valid email address.

You are responsible for:

You must be at least 18 years old to create an account. By registering, you confirm that you meet this requirement.

5. Subscriptions & Billing

Paid subscription plans are processed by Dodo Payments, our Merchant of Record for subscriptions. By subscribing, you agree to Dodo Payments' Buyer Terms in addition to these Terms. Klar's Bill Hub feature is not a payment processor: it lets you log a bill's reference number and amount for your own tracking, then opens the relevant utility or service provider's own official website in a new tab so you can pay them directly. Klar is never a party to, and never processes, that payment.

14-Day Free Trial

New subscribers to paid plans receive a 14-day free trial. You will not be charged until the trial ends. Cancel any time during the trial to avoid charges.

Renewals

Subscriptions renew automatically at the end of each billing cycle unless cancelled. You authorise Dodo Payments to charge your payment method on a recurring basis.

Cancellation

You may cancel at any time via Settings → Manage Subscription & Billing (Dodo Payments' Customer Portal). Cancellation takes effect at the end of the current billing period. Access to paid features continues until then. No partial refunds are issued for unused time in a billing period.

Refunds

All sales are final except where required by applicable consumer protection law. UK users have the right to cancel within 14 days of purchase under the Consumer Contracts Regulations 2013, unless digital content delivery has begun with your consent. SA users have rights under the Consumer Protection Act 68 of 2008. To request a refund, email billing@klarfinance.co.za. Approved refunds will be processed by Dodo Payments within 5–10 business days to your original payment method.

Price Changes

We may change subscription prices. We will give you at least 30 days' notice before any price change takes effect. Continued use after the change date constitutes acceptance of the new pricing.

6. Free Plan

The Free plan is available at no cost and includes core transaction tracking, budgeting, and savings features. It is limited to 6 months of transaction history and local storage only (no cloud sync).

We reserve the right to modify Free plan features. We will provide at least 30 days' notice before removing a feature that was previously available on the Free plan.

7. Acceptable Use

You agree not to:

Violation of these restrictions may result in immediate termination of your account without refund.

8. Your Data & Content

You own all financial data you enter into Klar. We do not claim ownership of your transactions, budgets, goals, or any other content you create.

By enabling cloud sync, you grant Klar a limited licence to store and process your data solely to provide the Service to you. This licence terminates when you delete your cloud data or close your account.

You are responsible for ensuring that the data you enter does not infringe the rights of others (e.g. entering another person's financial details without their consent).

You can export all your data at any time via Settings → Data Management. You can delete all data via Settings → Data Management → Reset all data.

9. AI Advisor Disclaimer

Important: The AI Advisor is not a regulated financial adviser. Responses are generated by a large language model (Groq / LLaMA) and may be inaccurate, incomplete, or unsuitable for your specific circumstances. Do not make significant financial decisions — including investment, tax, debt, or pension decisions — based solely on Klar AI responses.

Klar's AI Advisor is provided for general informational and educational purposes only. It does not constitute:

Always consult a qualified, FCA-authorised (UK) or FSP-licensed (SA) professional for advice tailored to your situation.

10. Third-Party Services

Klar integrates with third-party services including Supabase, Groq, Dodo Payments, Saltedge, Frankfurter, Crisp, and PostHog. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

Bank feeds (UK) are provided via Saltedge, a regulated account information service provider. Klar has read-only access to your bank data via Saltedge — we cannot initiate payments or move funds on your behalf. Klar itself is not currently FCA-authorised; our own Account Information Service Provider (AISP) registration is in progress and not yet complete.

11. Intellectual Property

The Klar application, including its design, code, branding, and content (excluding your personal data), is owned by Klar Money and protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use Klar solely for personal, non-commercial financial management purposes.

You may not copy, modify, distribute, sell, sublicence, or create derivative works from the Klar application without our express written permission.

12. Disclaimers & Limitation of Liability

No Warranty

Klar is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Financial calculations are estimates only and may not reflect your actual bank balances.

Not a financial record: Klar is a personal budgeting tool. Do not rely on Klar as your official financial record for tax, legal, or regulatory purposes. Always verify important figures against your official bank statements and consult a qualified accountant.

Limitation of Liability

To the maximum extent permitted by applicable law, Klar Money shall not be liable for:

Our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the greater of: (a) the total fees you paid to Klar in the 12 months preceding the claim; or (b) £50 / R1,000.

Consumer Rights

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded under applicable consumer protection law (including the Consumer Rights Act 2015 (UK) and the Consumer Protection Act 68 of 2008 (SA)).

13. Indemnification

You agree to indemnify and hold harmless Klar Money, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; or (c) your infringement of any third-party rights.

14. Termination

By you: You may stop using Klar at any time. To cancel a paid subscription, use Dodo Payments' Customer Portal (Settings → Manage Subscription). To delete just your cloud backup while keeping your login, use Settings → Privacy → Delete cloud data. To permanently delete your account itself (cloud data and login both, irreversible), use Settings → Privacy → Delete account permanently.

By us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice. In the event of termination for cause, no refund will be issued. We will endeavour to give you 14 days' notice for terminations not caused by a breach.

Effect of termination: Upon termination, your right to use the Service ceases. Your local data remains on your device until you clear it. Sections 8 (Your Data), 9 (AI Disclaimer), 11 (IP), 12 (Liability), 13 (Indemnification), and 15 (Governing Law) survive termination.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles.

For users in South Africa, you may also have rights under South African law. Nothing in these Terms limits the application of South African consumer protection law to South African users.

Dispute Resolution

We prefer to resolve disputes informally. Please email hello@klarfinance.co.za first and we will attempt to resolve the matter within 30 days.

If informal resolution fails:

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

Continued use of Klar after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
